Beacon Heating and Cooling ("Beacon," "we," "our," or "us"), operated by Beacon Biloxi LLC, respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains what information we collect, how we use it, and the choices you have.
1. Information We Collect
We collect information in the following ways:
- Information you provide directly: Your name, phone number, email address, service address, the nature of your service request, payment information, and any other details you provide when you contact us, request a quote, book a service, or apply for a job.
- Information we create while serving you: Service and maintenance records, diagnostic notes, photographs of your equipment and work areas taken by our technicians (see Job-Site Photographs below), and recordings of phone calls (see Phone Calls & Text Messages below).
- Information collected automatically: When you visit our website, we (and our service providers) may automatically collect technical information including your IP address, device type, browser, pages viewed, referring URLs, and approximate location.
- Information from third parties: We may receive information about you from booking platforms, review sites, advertising partners, and other service providers when you interact with us through those channels.
2. How We Use Information
We use the information we collect to:
- Schedule, perform, and follow up on HVAC services you request;
- Communicate with you about appointments, estimates, invoices, and warranty work;
- Document the condition of your equipment and the work performed, including through job-site photographs, for diagnostics, estimates, quality control, warranty support, and technician training;
- Process payments and maintain customer records;
- Respond to inquiries, reviews, and job applications;
- Improve our website, marketing, and customer service;
- Send service reminders, maintenance notices, or promotional offers (you can opt out at any time); and
- Comply with legal obligations and enforce our agreements.
3. Phone Calls & Text Messages
Call recording. Telephone calls to or from Beacon may be recorded or monitored for quality assurance, training, dispute resolution, and record-keeping purposes.
Text messaging. By providing your mobile phone number, you consent to receive text messages from Beacon Heating and Cooling related to your service, such as appointment confirmations, technician arrival updates, estimates, and invoices. If you separately opt in, we may also send occasional promotional offers and maintenance reminders by text. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out of text messages, or HELP for help. Opting out of promotional texts does not prevent us from sending non-promotional texts needed to deliver a service you have requested. Wireless carriers are not liable for delayed or undelivered messages.
No sharing of SMS opt-in data. Mobile phone numbers and text-message opt-in data are not shared with or sold to third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third party, except with service providers acting on our behalf solely to deliver those messages.
4. Job-Site Photographs
Our technicians routinely photograph equipment and work areas before, during, and after service. We use these photographs to document conditions, support estimates and warranty claims, maintain quality control, and train our team.
We may also use photographs of equipment and completed work in our marketing — for example, on our website, on social media, or alongside reviews. We do not publish photographs that identify you, your family, your address, or the exterior of your home without your permission. If you prefer that photographs from your project not be used in marketing, simply tell your technician or email us at team@beaconbiloxi.com and we will honor your request.
5. Sharing & Third Parties
We do not sell your personal information. We may share information with:
- Service providers that help us operate our business, including our online booking provider (Housecall Pro), payment processors, communications platforms (for calls and text messages), hosting providers, and analytics services.
- Manufacturers and warranty administrators when needed to register equipment or process warranty claims on your behalf.
- Legal and regulatory authorities when required by law, subpoena, or to protect our rights, property, or safety, or that of our customers or others.
- A successor entity in connection with a merger, acquisition, financing, or sale of all or part of our business.
As noted above, text-message opt-in data is never shared with third parties or affiliates for their marketing purposes.
6. Cookies, Analytics & Advertising
Our website uses cookies and similar technologies to remember your preferences, measure traffic, and improve performance. You can control cookies through your browser settings. Some features of the site may not work properly if cookies are disabled. We may also use third-party analytics tools (such as Google Analytics) to better understand site usage.
In addition, we may use advertising services and pixels (such as Google Ads or Meta) that collect information about your visit in order to show you relevant ads on other websites. Some state privacy laws treat this kind of disclosure as "sharing" personal information for targeted advertising. 7. Data Retention
We keep personal information only as long as reasonably necessary for the purposes described in this Policy. In general, we retain customer and service records for the duration of our relationship with you, plus the additional time needed to honor warranties on equipment and workmanship, maintain required business, tax, and insurance records, resolve disputes, and comply with legal obligations. In deciding how long to keep information, we consider the nature of the information, applicable equipment warranty periods, and our legal requirements. When information is no longer needed, we delete or de-identify it.
8. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect the information we collect. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.
9. Your Choices & Rights
You may:
- Ask us to access, correct, or delete personal information we hold about you;
- Opt out of marketing emails by following the unsubscribe link in any message or by contacting us directly;
- Opt out of marketing text messages by replying STOP;
- Ask that photographs from your project not be used in our marketing;
- Opt out of targeted advertising cookies as described in Cookies, Analytics & Advertising above; and
- Request information about how your data has been shared.
To exercise any of these rights, email us at team@beaconbiloxi.com. We will respond to verified requests within a reasonable time, generally within 45 days. Depending on where you live, additional rights may apply under state law (for example, the California Consumer Privacy Act).
10. Children's Privacy
Our website and services are not directed to children under 13, and we do not knowingly collect personal information from children. If you believe a child has provided information to us, please contact us and we will delete it.
11. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Material changes will be highlighted on this page or communicated directly when appropriate.
Terms of Service
These Terms of Service ("Terms") govern your access to and use of beaconbiloxi.com (the "Site") and any HVAC services provided by Beacon Heating and Cooling (Beacon Biloxi LLC). By using the Site or scheduling service with us, you agree to these Terms.
1. Acceptance of Terms
If you do not agree to these Terms, please do not use the Site or our services. We may update these Terms at any time, and continued use after changes means you accept the updated Terms.
2. Our Services
Beacon provides residential and light-commercial heating, ventilation, and air conditioning ("HVAC") services, including diagnostics, repair, installation, maintenance, and indoor air quality solutions on the Mississippi Gulf Coast. Specific work performed will be described in your written estimate, invoice, or service agreement.
3. Scheduling & Cancellation
Appointments may be scheduled by phone, email, or through our online booking partner. We make commercially reasonable efforts to arrive within scheduled windows but cannot guarantee exact arrival times due to factors outside our control (weather, traffic, emergency calls, etc.). Please contact us at least 24 hours in advance to reschedule or cancel a non-emergency appointment.
4. Pricing, Estimates & Payment
Estimates are provided based on the information available at the time and may be revised if the scope of work changes once a technician is on-site. We will communicate any changes before performing additional work.
Payment is due upon completion of services unless a separate written agreement (such as a maintenance plan or financing arrangement) provides otherwise. Past-due invoices may be charged a late fee of $100, plus interest on the unpaid balance at a rate of 1.5% per month (18% per year) or the maximum rate permitted by applicable law, whichever is less, accruing from the due date until paid in full. You are also responsible for our reasonable costs of collecting past-due amounts, including reasonable attorneys' fees, to the extent permitted by law.
5. Customer Responsibilities & Site Conditions
To allow us to perform work safely and efficiently, you agree to:
- Provide safe and timely access to the work areas, including clearing stored items from around equipment, attic accesses, and crawl-space entries;
- Secure pets away from work areas for the duration of the visit;
- Ensure that an adult (18 or older) is available to authorize work when required;
- Provide accurate and complete information about your equipment, its service history, and any known problems; and
- Disclose any known hazards on the property, such as asbestos, mold, pest infestations, structural issues, or electrical problems.
Concealed and hazardous conditions. If we encounter concealed, unforeseen, or hazardous conditions during the work — such as mold, asbestos, biological hazards, pest infestation, faulty wiring, or structural deficiencies — we may pause work until the condition is addressed. Remediation of such conditions is outside the scope of our services unless expressly included in your estimate, and we will discuss any revised scope or pricing with you before continuing where feasible.
Pre-existing conditions. Beacon is not responsible for pre-existing defects, damage, code violations, or unpermitted prior work in your home, equipment, or systems, and is not obligated to correct them unless expressly included in your written estimate.
Access and cosmetic restoration. Some work requires openings in walls, ceilings, or floors, or the temporary relocation of belongings. We take reasonable care in performing this work, but unless expressly stated in your estimate, our pricing does not include cosmetic restoration such as drywall patching and finishing, paint, wallpaper, flooring, or landscaping.
6. Permits & Code Compliance
Certain work — typically new construction and some full-system installations — may require permits or inspections from the local authority having jurisdiction. Whether a permit is required is determined by the applicable local code at the time of the work. Where a permit is required for the work described in your written estimate, we will identify it, and permit and inspection fees will be itemized in your estimate or invoice unless otherwise stated. Routine service, maintenance, and many repair jobs do not require permitting.
Beacon is not responsible for pre-existing unpermitted work or pre-existing code violations, and our pricing does not include upgrades to existing systems, structures, or utilities required to bring them into compliance with current codes, unless such work is expressly included in your estimate. If a code requirement or the authority having jurisdiction obligates additional work after the job begins, we will notify you and price that work before proceeding. You are responsible for obtaining any approvals required by a homeowners' association, landlord, or historic district, and for notifying us of those requirements before work begins.
7. Warranties
Beacon stands behind its workmanship. Specific labor and parts warranties will be set forth on your invoice or service agreement. Manufacturer warranties on installed equipment are administered by the manufacturer; we will assist in submitting valid warranty claims.
Workmanship warranties do not cover damage or failures caused by misuse, neglect, failure to perform recommended maintenance, alterations or repairs by anyone other than Beacon, power surges or utility problems, or acts of nature.
8. Maintenance Plans
If you enroll in a Beacon maintenance plan or membership, the plan's separate written terms — including pricing, billing frequency, renewal, and cancellation — are provided at enrollment and govern the plan. If those terms conflict with these Terms, the plan terms control with respect to the plan.
9. Disclaimers
EXCEPT FOR WRITTEN WARRANTIES PROVIDED ON YOUR INVOICE OR SERVICE AGREEMENT, OUR SERVICES AND THIS SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BEACON BILOXI LLC AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR SERVICES. Our total liability for any claim arising out of or related to a particular service will not exceed the amount you paid us for that service.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, INCLUDING, WHERE PROHIBITED BY LAW, LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR PERSONAL INJURY CAUSED BY NEGLIGENCE. Some jurisdictions do not allow certain limitations of warranties or damages, so portions of this section may not apply to you.
11. Website Use & Intellectual Property
All content on the Site — including text, graphics, logos, images, and code — is owned by Beacon Biloxi LLC or its licensors and is protected by copyright, trademark, and other laws. You may view and use the Site for personal, non-commercial purposes only. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written permission.
You agree not to use the Site for any unlawful purpose, to interfere with its operation, or to attempt to gain unauthorized access to any portion of the Site or related systems.
12. Third-Party Links
The Site may link to third-party websites or services (such as Google Maps, Yelp, Facebook, Angi, and our booking provider). We are not responsible for the content, privacy practices, or terms of those third parties. Use them at your own risk.
13. Governing Law
These Terms and any dispute arising from them or from our services are governed by the laws of the State of Mississippi, without regard to its conflict-of-law principles. The exclusive venue for any dispute shall be the state or federal courts located in Harrison County, Mississippi, and you consent to personal jurisdiction in those courts.
14. General Provisions
- Entire agreement. These Terms, together with your written estimate, invoice, service agreement, and any maintenance plan terms, constitute the entire agreement between you and Beacon regarding the services and the Site, and supersede any prior or contemporaneous understandings. If these Terms conflict with a signed estimate or service agreement, the signed document controls with respect to that work.
- Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
- No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, financing, or sale of all or part of our business.
- Force majeure. Beacon is not liable for delays or failures in performance caused by events beyond our reasonable control, including severe weather, natural disasters, utility outages, labor or supply shortages, and government actions.
15. Changes to These Terms
We may modify these Terms from time to time. The most current version will always be posted on this page with the updated "Last Updated" date.
